(RepublicanDaily.org) – Presidential son Hunter Biden has dropped his bid for a new trial after the prosecutorial team chided his side for failing to understand appellate court rules.
Biden, 54, was convicted of three counts on June 11 of lying regarding his addiction to drugs like crack cocaine when he was applying for a gun permit. Unhappy with the conviction, on June 24 Hunter filed a motion for a new trial on the grounds that, in his belief, Judge Maryelln Noreika did not have proper jurisdiction over his trial in the first place.
Federal prosecutors made great hay with this, shooting back at Hunter that his team had a “misunderstanding of appellate practice” and appeared not to have even read prior court rulings. David Weiss is the special prosecutor in charge of the case against Hunter. His team filed a response to Hunter Biden on July 8 pointing out what his lawyers apparently missed: the Third Circuit Court of Appeals had already ruled on the question. The court authorized Noreika to preside over Hunter’s trial.
Prosecutor Derek Hines wrote in his filing that both of Hunter’s appeals were already dismissed by the Third Circuit which denied him a new trial. Apparently Hunter believed that his act of appealing his conviction somehow took his case out from under the jurisdiction of Noreika’s court. This is not the case. Hines called Hunter’s theory a “laughable tale.”
Both prior dismissals were clearly marked “Issued in Lieu of Mandate,” Hines wrote, and there was no legal basis to claim that the court revisit the question of jurisdiction.
Hunter’s defense lawyer, Abbe Lowell, filed a motion the next day withdrawing the request for a new trial.
Hunter Biden was prosecuted for lying about his drug addiction status when filing a permit to own a gun. The president’s son is widely known to have been addicted to crack cocaine. His infamous laptop, abandoned at a computer repair shop and later discovered, was filled with images and documents depicting Hunter Biden appearing to consort with prostitutes while smoking crack cocaine.
