They alleged the materials were classified and that Trump’s possession of them was unlawful. The former president and his legal team have protested these allegations. His attorneys are now casting doubt on the Department of Justice’s (DOJ) reliability.

Trump’s legal team and the DOJ locked horns over the former’s application for the appointment of an independent special master to decide whether the documents were indeed classified. The 45th president’s attorneys have remained steadfast in their assertion that the DOJ’s interpretation of the law in this area is deliberately flawed.

A number of renowned legal experts agree. Margot Cleveland, the senior legal correspondent with The Federalist, published a thread on Twitter arguing the records the DOJ took from Trump were personal, rather than presidential. If this is the case, she says, the agency’s investigation should find the former president innocent of wrongdoing.

Conservative legal expert Mike Davis agreed with Cleveland, highlighting that the Presidential Records Act makes certain records available to former commanders-in-chief and opining that the former president’s attorneys have “the winning legal arguments.”
