The appeal to prevent Pence from testifying was dubbed a “long shot” by media analysts, CNN reported. Trump’s legal appeal of the subpoena was first reported by Bloomberg.
Special Counsel Jack Smith, the special advisory council appointed by Attorney General Merrick Garland to investigate Donald Trump’s involvement in the events of January 6, 2021, when a rabble burst into Congress during the processing of the electoral college votes for the 2020 presidential election.
Political analysts continue to mull the potential for Special Counsel Jack Smith to bring charges against the former president soon, Slate magazine wrote.
A federal judge’s recent decision summons former Vice President Mike Pence to testify on the conversations he had with the former president on January 6. The former vice president had attempted to appeal the subpoena previously, citing the U.S. Constitution’s “Speech or Debate Clause,” Reuters reported.
Pence stated that, once a subpoena was issued, he had no plans to fight the summons, NBC reported. Trump attempted to appeal the conversations he had with Pence citing executive privilege clauses, Politico reported. The attempts to cite executive privilege reportedly failed to convince federal and appellate judges. Former Obama White House counsel Ned Eggleston said that Trump was “destined to lose” his executive privileges in this case. Eggleston is an expert in presidential privilege issues, and CNN referred to him as one of the “most experienced” lawyers on the subject.
Pence Spokesman Dylan O’Malley told reporters that the former vice president would comply with the subpoena “as required by law,” Politico reported.
Trump has since commented on the “boxes hoax” on his Truth Social media, claiming that he “did nothing wrong” but rather that “Biden did,” and that the Democrats were only using the case for “election interference.” Trump claimed that his people were being “threatened and harassed” by what he called a “thug” prosecutor.
